1. Acceptance of Terms

By accessing or using the DayGuide AI platform and any of its features — including Activities, Games, Daily Chronicles, Menus, Calendar, Pass Time Activities, Spiritual Reflections, Budget with Nova, Field Trip Finder, DayGuide Design Studio, Nova AI Assistant, Participant Profiles, Programs, Reports & Analytics, and all other features — you agree to be bound by these Terms of Service.

2. Use of Service

DayGuide AI provides a content generation, activity management, and care engagement platform designed for senior care facilities and adult activity environments. You agree not to enter Protected Health Information (PHI) or sensitive medical data into any field on the platform.

3. Participant Profiles & De-Identified Data

The Participant Profiles feature allows facility staff to store de-identified, non-medical lifestyle and preference information. In compliance with HIPAA Safe Harbor de-identification standards (45 CFR §164.514(b)), this feature is strictly limited to anonymous, non-identifying data — including a pseudonym or nickname assigned by staff, interests, hobbies, music preferences, engagement styles, and general background notes. No real names, dates of birth, photographs, or any of the 18 HIPAA-defined identifiers may be stored.

4. Subscription Plans & Fees

• Family Essentials — $39/month ($421/year): Games and Participant Profiles. For families and small home-care settings.
• Starter — $79/month: Daily Chronicles, Activities, Calendar, Games, and Pass Time Station.
• Professional — $199/month: Everything in Starter, plus Programs, Event & Party Planning, Menus & Recipes, Spiritual Reflections, Field Trip Finder, Prep View, Saved Library, DayGuide Design Studio, Reports & Analytics, Nova AI Assistant, Budget with Nova, Supply Cabinet, Exercise Videos, and Participant Profiles. 1 facility included.
• Growth — $599/month ($6,468/year): Full platform access for growing multi-location organizations. Up to 3 facilities included.
• Scale — $899/month ($9,708/year): Full platform access for scaling networks. Up to 5 facilities included.
• Regional — $1,499/month ($16,188/year): Full platform access for regional networks. Up to 10 facilities included.
• Enterprise — $2,499/month ($26,988/year): Full platform access for large organizations. Up to 20 facilities included. Includes dedicated support.
• Enterprise Plus — Custom Pricing (Contract Required): 20+ facilities (custom), dedicated account manager, SLA guarantees, on-site training & onboarding.

Annual billing available at approximately 10% off the monthly equivalent. All prices in USD. Subscriptions auto-renew unless cancelled before renewal.

5. Cancellation & Refunds

You may cancel at any time through your account settings or by contacting support@dayguideai.com. Cancellations take effect at the end of the current billing period. No prorated refunds for partial billing periods unless required by applicable law.

13. No Medical or Professional Advice

DayGuide AI is a content generation and activity management tool. Nothing on the platform constitutes medical, therapeutic, clinical, dietary, legal, or professional advice of any kind.
